1. About KittensNest

KittensNest.com ("KittensNest", "we", "us") operates an online directory that lets cat breeders, rescues, shelters, and private owners publish listings for kittens and cats, and lets prospective buyers and adopters find and contact them.

We are an advertising platform only. We do not own, breed, house, inspect, transport, or sell any animal listed on this site, and we are not a party to any transaction between a buyer and a seller.

2. Eligibility

You must be at least 18 years old to create an account, publish a listing, or contact a seller through KittensNest. By using the site you confirm that you meet this requirement and that all information you provide is accurate.

You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately if you believe your account has been accessed without your permission.

3. No payments pass through KittensNest

KittensNest does not process, hold, escrow, or refund any payment between a buyer and a seller. We do not accept deposits, purchase prices, or adoption fees on anyone's behalf.

All money changes hands directly between you and the other party, using whatever method you two agree on. Because we are never in the middle of that transaction, we cannot reverse it, mediate it, or guarantee its outcome.

The only payments we ever collect are optional membership subscription fees — for buyers or for sellers — paid directly to KittensNest, described in Section 7.

4. Your dealings with other users

Any contract for the sale, adoption, transfer, deposit, health guarantee, or delivery of an animal is strictly between the buyer and the seller. KittensNest is not a party to it and assumes no liability under it.

We do not verify sellers, and we do not check the accuracy of listings, photographs, pedigrees, registration papers, health records, or any other statement a seller makes. Nothing on this site — a listing's placement, a paid plan, a badge, or any label we display — is an endorsement of a seller or a guarantee of an animal's health, temperament, or lineage.

You are solely responsible for your own due diligence. We strongly recommend that you video-chat with the seller, ask for veterinary records, visit in person where possible, and never wire money, send gift cards, or pay by irreversible means. See our Safe Buying Tips for more guidance.

You agree that KittensNest is not liable for any loss, injury, illness, fraud, misrepresentation, financial damage, or dispute arising out of your interaction with another user, whether online or offline.

5. Listing rules for sellers

You may only list animals that you personally own or are legally authorized to rehome. Listings must be truthful, must use photographs of the actual animal being offered, and must state the price or adoption fee honestly.

You are responsible for complying with all federal, state, and local laws that apply to you, including breeder licensing, minimum age at separation, health certificate, and animal welfare requirements in your jurisdiction and in the buyer's.

The following are prohibited: listing animals you do not have, requesting deposits for animals that do not exist, misrepresenting breed or health status, listing prohibited or protected species, and any form of animal cruelty or neglect.

We may edit, decline, suspend, or remove any listing or account at our discretion, at any time, with or without notice, including for suspected fraud or for conduct that harms other users.

6. Acceptable use

Do not use KittensNest to harass, threaten, defraud, or spam other users; to scrape, copy, or republish our content or user listings; to introduce malware; or to circumvent our security or access controls.

You retain ownership of the text and photographs you upload. By posting them you grant KittensNest a non-exclusive, worldwide, royalty-free license to display, resize, and distribute that content for the purpose of operating and promoting the platform.

You confirm you own or have permission to use everything you upload, and that it does not infringe anyone else's copyright. See our DMCA process on the Contact page to report infringement.

7. Memberships and subscriptions

KittensNest offers optional paid memberships to both sellers and buyers. Seller plans provide listing tools and additional visibility for your kittens; buyer plans provide enhanced search, saved-listing, and alert features. Browsing the site and contacting a seller do not require a paid plan.

Pricing, billing period, and the features included in each plan are shown on the Membership page at the time you subscribe. Those are the terms that apply to your purchase.

Subscriptions renew automatically for the same period until cancelled. You may cancel at any time, effective at the end of your current billing period; unless required by law, fees already paid are non-refundable. We will tell you before a renewal price changes.

A paid membership buys access to features on our platform. It is not a guarantee of a sale, an inquiry, a particular search placement, or the availability of any specific kitten, and it never makes KittensNest a party to a transaction between users.

8. Partner services

We link to independent partner companies for pet transport and veterinary care, sometimes with a discount code. These partners are separate businesses that we neither own nor control.

Any service they provide is governed by their own terms and their own pricing. KittensNest is not responsible for their performance, availability, delays, or for any damage or injury arising from their services.

9. Disclaimer of warranties

KittensNest is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, secure, or error-free, or that any listing or user-supplied information is accurate, current, or complete.

10. Limitation of liability

To the maximum extent permitted by law, KittensNest and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or veterinary, transport, or replacement costs, arising from your use of the site or your dealings with any user or partner.

To the maximum extent permitted by law, our total aggregate liability to you for any claim relating to KittensNest will not exceed the greater of (a) the total buyer or seller membership fees you paid us in the twelve months before the claim, or (b) one hundred US dollars ($100). The fixed minimum applies because most of our users never pay us anything, and we do not intend to leave those users without any remedy at all.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, willful misconduct, or personal injury caused by us. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless KittensNest and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising from your listings, your content, your breach of these Terms, or your dealings with another user.

12. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access at our discretion, including for breach of these Terms or for conduct that puts other users or animals at risk.

13. Changes to these Terms

We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent version, and your continued use of KittensNest after a change means you accept the revised Terms.

14. Governing law and contact

These Terms are governed by the laws of the United States and of the state in which KittensNest is operated, without regard to conflict-of-law rules.
